Tree Removal Assistance Pilot Program (TRAPP)

Effective January 1, 2015, the Association instituted a Tree Removal Assistance Pilot Program (TRAPP) to help homeowners remove dead, dying, or diseased trees from their properties. The purpose of this program is to help foster compliance with the Association’s covenants, rules, regulations, and guidelines regarding maintenance of landscaping and to help mitigate potential dangers that dead, dying and diseased trees pose to neighboring properties. The Association’s Board of Directors is empowered with complete discretion to provide funding for the TRAPP as it sees fit. Furthermore, the Board of Directors has the discretion to select participants for the TRAPP based upon any non-discriminatory factors or qualifications it sees fit. Through the TRAPP, the Association will provide homeowners with up to a $2,000.00 loan towards the expense of removing dead, dying, or diseased trees. To participate in the TRAPP, a homeowner must enter a written agreement to repay the full amount of their loan within 12 months of disbursement in equal monthly payments (“TRAPP Agreement”). The loan will be collectable as an assessment against the homeowner(s) and their property pursuant to the Smoky Hill Homeowners Association Revised Protective Covenants for Smoky Hill 400 Community recorded with the Arapahoe County Clerk and Recorder on January 31, 2003, at reception number B3022630 (“Declaration”) as well as the Colorado Common Interest Ownership Act (C.R.S. §§ 38-33.3-101 to -402 (2019))(“CCIOA”). If a homeowner fails to make the agreed-upon payments to repay their loan, the Association can accelerate the full loan amount due and pursue collection of the past due amounts pursuant to its collection policy. Before entering a TRAPP Agreement, a homeowner must select a licensed, insured, and bonded contractor and obtain the Association’s approval to use that contractor.  The Association will disburse the loan proceeds directly to the contractor after the contractor has completed the work and the Association has received a copy of the invoice to the homeowner.

The Association expressly disclaims any responsibility or liability for the work performed by contractors chosen by the homeowners who participate in the TRAPP.
